Please read these Terms of Service (“Terms,” “Agreement”) carefully before using the “Display Your Painting in a Virtual Room” feature (“the Feature”) offered by Urartstudio.com (“the Website”). This Agreement sets forth the legally binding terms and conditions for your use of the Feature.
By using the Feature, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not access or use the Feature.
- Feature Usage 1.1 Eligibility: The Feature is available for all users who are at least 18 years old. By using the Feature, you represent and warrant that you are of legal age to form a binding contract with Urartstudio.com.
1.2 Account Creation: In order to use the Feature, you may be required to create an account on the Website. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You accept responsibility for all activities that occur under your account.
1.3 Artwork Ownership: You retain full ownership of the paintings uploaded by you to the Virtual Room Exhibition feature. By uploading your paintings, you grant Urartstudio.com a non-exclusive, royalty-free, worldwide license to use, display, and promote your paintings within the Feature.
1.4 Compliance with Laws: You agree to comply with all applicable laws, rules, and regulations while using the Feature. You are solely responsible for ensuring that your use of the Feature does not violate any intellectual property rights or other rights of third parties.
- Virtual Room Exhibition Feature 2.1 Painting Upload: You may upload your paintings to the Virtual Room Exhibition feature for display. You agree to upload paintings that you own the rights to or have obtained appropriate permissions for. Urartstudio.com reserves the right to remove any paintings it deems inappropriate or in violation of these Terms.
2.2 Painting Customization: You may customize the display of your paintings within the Virtual Room Exhibition feature. However, any distortions or modifications should not infringe upon the rights of third parties or violate any applicable laws.
2.3 Wall Color Selection: The Virtual Room Exhibition feature allows you to adjust the wall colors for your virtual gallery. While selecting wall colors, you must ensure that they do not violate any intellectual property rights or other rights of third parties.
2.4 Virtual Room Selection: You may choose from available virtual rooms for the exhibition of your paintings. These rooms are provided for aesthetic purposes and should not depict any offensive or illegal content.
2.5 Adjustable Drop Shadow: The Feature includes an adjustable drop shadow option to add depth and dimension to your paintings. You agree to use this option responsibly without misrepresenting your artwork or infringing upon the rights of others.
2.6 Restoration and Deletion Options: You have the ability to restore or delete your paintings within the Virtual Room Exhibition feature. You are solely responsible for managing your exhibition, including updating and removing paintings as necessary.
- Future Feature Enhancements 3.1 Frames: Urartstudio.com may introduce the option to add frames to your paintings within the Virtual Room Exhibition feature. The availability and specific details of this option will be communicated separately.
3.2 New Gallery Rooms: Additional virtual rooms may be added to enhance the variety and versatility of the Virtual Room Exhibition feature. Urartstudio.com reserves the right to introduce new rooms at its discretion.
- Intellectual Property 4.1 Website Content: All content within the Virtual Room Exhibition feature and the Website, including but not limited to text, graphics, images, logos, and software, is the property of Urartstudio.com and protected by copyright laws and other intellectual property rights.
4.2 Limited License: Urartstudio.com grants you a limited, non-exclusive, non-transferable license to access and use the Feature solely for your personal and non-commercial purposes. You must not reproduce, distribute, modify, or create any derivative works based on the content of the Feature without explicit permission from Urartstudio.com.
- Limitation of Liability 5.1 Returns: Due to the nature of this virtual digital subscription, there are no returns or refunds available.
5.2 Lifetime Membership: If the customer decides to purchase the “Lifetime” membership, which is a one-time payment without a recurring monthly fee, all terms and conditions outlined in this Agreement also apply to this level of membership.
5.3 Disclaimer of Warranties: The Feature is provided on an “as-is” and “as available” basis, without any warranties, express or implied. Urartstudio.com does not warrant that the Feature will be uninterrupted, error-free, or secure. You use the Feature at your own risk.
5.4 Limitation of Liability: Urartstudio.com and its affiliates, directors, officers, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the Feature or any content displayed within it.
- Modification of Terms Urartstudio.com reserves the right to modify or update these Terms of Service at any time, without prior notice. The updated Terms will be effective upon posting on the Website. It is your responsibility to review these Terms periodically. Your continued use of the Feature after any modifications shall constitute your consent to the updated Terms.
- Termination Urartstudio.com may terminate or suspend access to the Feature immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
- Governing Law These Terms shall be governed by and construed in accordance with the laws of the United States of America, specifically the state of Ohio. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ohio.
By using the “Display Your Painting in a Virtual Room” feature, you acknowledge that you have read, understood, and agreed to these Terms of Service.
